Terms of Service

1. Acceptance of Terms

By accessing or using the Arqstar platform ("Service"), provided by Main Method LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Arqstar is a software-as-a-service (SaaS) platform designed to streamline architectural review processes for Homeowner Associations (HOAs), neighborhood boards, and residents. The Service allows users to submit architectural requests, manage properties, review submissions, vote on requests, and maintain audit logs.

3. Account Registration and Responsibilities

3.1 Eligibility

You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that you are capable of entering into a binding contract.

3.2 User Accounts

  • Residents: May use the Service to submit requests, view status updates, and manage their profile.
  • Board Members/Chairs: Have additional privileges to review requests, cast votes, and manage neighborhood settings.
  • Administrators: Have full access to manage users and system configurations.

3.3 Account Security

You are responsible for maintaining the confidentiality of your login credentials (managed via Auth0) and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account.

4. User Conduct

You agree not to use the Service to:

  1. Submit false or misleading information regarding property modifications or personal identity.
  2. Upload malicious code, viruses, or harmful files.
  3. Harass, abuse, or harm other users, board members, or Company staff.
  4. Interfere with or disrupt the integrity or performance of the Service.
  5. Attempt to gain unauthorized access to other neighborhoods, accounts, or systems.

5. Intellectual Property

5.1 Company IP

The Service, including its codebase, design, logo, and architecture, is the exclusive property of Main Method LLC and is protected by copyright, trademark, and other intellectual property laws.

5.2 User Content

You retain ownership of the data, files, and images you upload ("User Content"). By submitting User Content, you grant the Company a worldwide, non-exclusive, royalty-free license to use, store, and display such content solely for the purpose of providing the Service to you and your neighborhood association.

6. Payment and Subscription

If the Service is provided on a subscription basis, fees are billed in advance. Failure to pay may result in suspension or termination of access. Main Method LLC reserves the right to modify pricing with reasonable notice.

7. Limitation of Liability

To the maximum extent permitted by law, Main Method LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

The Company provides the platform "AS IS" and makes no warranties regarding the approval or denial of any specific architectural request. Decisions made by neighborhood boards are independent of Main Method LLC.

8. Third-Party Services

The Service may integrate with third-party providers (e.g., Auth0 for authentication, AWS/Google Cloud for storage, Google Analytics). Your use of these services is subject to their respective terms and policies.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
